​The ArtbyHelene website and related services are made available to you in accordance with the following terms and conditions, as well as any other rules posted on our website. Please read these terms and conditions carefully before placing any orders on www.artbyhelene.no.
Art by Helene Østgård is a company registered in Norway under organization number 934436326. Our registered address is Othilie Tonningsvei 14A, 0486 Oslo.

We particularly want to draw your attention to our policies related to purchase terms within these terms and conditions and our privacy policy. By visiting our website or using any part of it and/or purchasing something from us, you engage in our service and agree to be bound by these terms and conditions. We reserve the right to update the terms and conditions from time to time.

Price

The listed price for the product is the total amount the buyer must pay. NOTE: Shipping costs are not included. Shipping costs will be added, and you will have the option to choose your preferred shipping method before you place the order.

Agreement

Once you complete your order in our online store, the agreement becomes binding, and the product will be prepared for shipping. If you have placed the order by mistake, please contact us immediately to request a cancellation.

Payment

Payment for all our products is made through our designated payment solutions. We only accept direct payments and use services such as Visa, MasterCard, and other card operators. You can also choose to pay with PayPal or Vipps. You will be redirected to their payment page, where you must log in and review your order before completing the payment.

Shipping

For orders within the EU, shipments are sent on a DDP (Delivery Duty Paid) basis, meaning all taxes and duties are included in the final price. Orders outside the EU are sent on a DDU (Delivery Duty Unpaid) basis, meaning taxes and duties are excluded from the final price. Your order may therefore be subject to local taxes and import fees imposed by your local customs authority or the shipping company. We are unable to calculate the exact amount of customs and duties that may apply to your order, as these costs are imposed directly based on customs and postal codes in Norway, the UK, and the US. Art by Helene does not cover such taxes, duties, or related charges. Taxes and duties on rejected or uncollected packages are not covered by Art by Helene.

If no delivery time is specified in the order process, the product will be delivered no later than 30 days after your order. You can select your preferred delivery method before payment is completed, and the associated costs will be added to the shopping cart and displayed before the payment is finalized.

Delays

Once you receive the product, you are responsible for any damages that may occur.

In the event of a delayed delivery, you may claim compensation for losses caused by the delay unless Art by Helene can prove that the delay was due to circumstances beyond the seller's control, such as general labor disputes, extreme weather, pandemics, acts of war, fire, lightning strikes, terrorist attacks, changes in government regulations, technical issues, power/telecom/data communication outages, or delays from subcontractors caused by the aforementioned circumstances. Such conditions may excuse liability for damages and other measures. If such a situation occurs, Art by Helene will inform you at the beginning and end of the period. If the situation lasts for more than four months, both you and Art by Helene have the right to cancel the purchase with immediate effect.

Returns

We accept returns and exchanges within 14 days after you have received the product. For the return to be approved, the item must be unused and in the same condition as when you received it. It must also be in its original packaging. You will be held responsible for any damages that occur during the return shipment. Therefore, we recommend packing the product securely and using a reliable shipping method. You are responsible for covering any return shipping costs.

Before returning a product, please email us at oestgaardhelene@gmail.com with your order number and request.

Once we confirm your request, you can send the product to the address provided. If returning a product from outside the EU, please clearly mark the package as a RETURN ORDER. Failure to do so may result in import fees or charges that will be balanced against your order. When returning a package, ensure you use a trackable shipping method. We are not responsible for lost packages. We reserve the right to deny a refund if the returned package is damaged, incomplete, or does not meet our return policy requirements.

Rights and Complaint

If you receive a damaged or defective product, please contact Art by Helene immediately.

It is important to note that small cracks and irregularities in our artwork are part of the design and therefore not considered valid for complaints. However, larger cracks, missing elements, or materials should be reported.

Please inspect your items for damage upon delivery. Any visible external damage to the packaging should be reported to us. You should also note the damage when receiving the package and ask the driver or pick-up location to document it. If you discover transport damage after opening the package, contact Art by Helene immediately.

For transport damage, email oestgaardhelene@gmail.com with a description, photos of the damage and packaging, and your order number. To claim damages from the shipping company, we must report transport damages within 1–3 business days. Therefore, we appreciate it if you notify us within that timeframe.
